The Charity Cars Donation Process

>> Wednesday, November 4, 2009

To donate a vehicle call 1-800-CHARITY (1-800-242-7489 x 2) or donate online. Once we receive your information we will make an initial determination whether your vehicle may be suitable to be used as a “program” car (to be provided to a client) or whether the vehicle will be sold at auction or for salvage. If your vehicle is not suitable to be a “program” car, (In the sole opinion of Charity Cars and/or its representatives), we will either e-mail or send you a letter stating that “your vehicle does not meet our criteria to be a program car. Your vehicle will be sold and you will be sent a tax-voucher within 30 days of the sale that will include the sales price that you must use to value your donation.”*

"Program Vehicles"

If your vehicle is tentatively accepted to be used as a “program” car we will either e-mail or send you a letter stating that “based on the information that you have provided regarding the condition of your vehicle, your vehicle may be used in our program and be provided to a disadvantaged person. Once we receive your signed, transferable title, we will make arrangements to have your vehicle picked up and inspected by a repair facility or a representative of Charity Cars. (Included in this letter will be a summary of the condition of the vehicle that you are donating. If there are any discrepancies please contact us immediately. Once the vehicle has been picked-up it cannot be returned to you.*) If the condition of the vehicle has been accurately conveyed to our representatives, (In the sole opinion of Charity Cars and/or its representatives), then your vehicle will be used as a “program” car and be provided to a client and we will send you a tax-voucher stating that you may deduct the “fair market value” of your donation within 30 days of the pick up. (Assistance in determining the “fair market value” can be found at www.kbb.com Kelly Blue Books’ website. Use private party value as a guide.) If, based on inspection, your vehicle has not been accurately represented to us then your vehicle will be sold and you will be sent a tax-voucher within 30 days of the sale that will include the sales price that you must use for your tax deduction.”*

Non-Program Vehicles

If your vehicle does not meet our “program” criteria, it will be sold: The tow service will contact you to schedule a convenient time to pick up your vehicle at no charge. In preparing your vehicle’s title for transfer, write the name Charity Cars, Inc. on the "buyer/purchaser" line and sign your name where it states “seller” exactly as it appears on the title. The tow truck driver will pick up your vehicle as well as the title. If you are uncomfortable about handing your title to the tow truck driver, you can make prior arrangements with the donation representative to mail your title to the Charity Cars headquarters.

Again, once the vehicle is sold you will receive a tax-voucher within 30 days of the sale reflecting the sales price that you may deduct. If, on the other hand, your vehicle is accepted as a “program” car, you will receive a tax-voucher stating that you may deduct the “fair market value.”(According to the IRS, the donor, not the recipient charity, must determine the “fair market value” which the IRS describes as the price that a willing buyer and a willing seller would agree on if neither were pressured to do so. Assistance with vehicle values can be found at www.kbb.com Kelly Blue Books web site. Use private party value.)

Vehicle Donations and the new tax law

Beginning January 1, 2005, new federal tax legislation governing vehicle donations goes into effect. The following is a summary of the new legislation contained in (HR 4520).

Under the new law, allowable deductions for charitable contributions of vehicles, boats and airplanes (collectively referred to as “assets” in this summary) for which the claimed value exceeds $500 will depend how the asset is used by the recipient charity. If the organization sells the asset without any significant intervening use or material improvement, the donor’s deduction is limited to the gross sales proceeds received by the charity. But, if the organization uses the asset in direct furtherance of its charitable purpose the donor may deduct the “fair market value” of the asset. (According to the IRS, the donor, not the recipient charity, must determine the “fair market value” which the IRS describes as the price that a willing buyer and willing seller would agree upon if neither were pressured to do so. Assistance with vehicle values can be found at www.kbb.com Kelly Blue Book’s web site. Use private party value as a guide.).

Examples: If a vehicle with a “fair market value” of $4000 is donated directly to the non-profit charity and the organization sells the vehicle for $1000, the donor can only deduct $1000. But, if for instance, the organization provides the vehicle to a disadvantaged person, the donor may deduct the full “fair market value” of $4000.

Substantiation requirements when the claimed value exceeds $500 are as follows: No deduction is allowed unless the donor receives a written acknowledgement from the charity. That document must include the name and taxpayer identification number (social security number) of the donor and the vehicle identification number (or similar number) of the asset.

Additional documentation is required but is dependant on how the asset is used by the charity:

In the event the charity sells the asset without any significant intervening use or material improvement, the charity must send a written acknowledgement to the donor within 30 days of the sale certifying (1) that the asset was sold at an arms length transaction between unrelated parties, (2) the amount of the gross sales proceeds, and (3) include a warning that the donor’s deduction is limited to the sales proceeds.

If the charity intends to make significant use of the donated asset (such as providing a donated vehicle to a disadvantaged person) or make material improvements, the required written acknowledgement must be provided within 30 days of the contribution and must certify: (1) the intended use and duration of such use or the material improvements to be made and (2) that the asset will not be transferred in exchange for money, other property, or services before completion of such use or improvements.

FAQ about Free Charity Cars

FAQ
1) Q-Who is FREE Charity Cars?
A-Charity Cars, Inc., a 501-C-3 non-profit charity. Federal EIN 59-3362703.

2) Q-In what states do you give away cars?
A-We award vehicles all across America, even as far away as Hawaii and Alaska.

3) Q-It appears from your website that many times the cars are given away at very public events. Is this always the case?
A-No. Actually the majority of the over 4000 cars that we have given away thus far have not been awarded at very public events.

4) Q-How can I win a car?
A-You cannot "win" a car as this is not a lottery, or game of chance.

5) Q-Can I just buy one of your Charity Cars?
A-No, we do not ever sell these "program" vehicles.

6) Q-Once I create a profile, fill out the application, and attain 100 votes, how long does it take to get a car?
A-It's impossible to say for sure because it depends on so many variables and as we rely on quality vehicle donations, we are at the mercy of the donating public. Once all milestones have been attained, an applicant qualifies to have their application reviewed. Once a vehicle becomes available in a particular geographic location, our team begins reviewing the applications of our members with the most votes / highest page rank who live in that general vicinity. Even if your page rank is lower than someone else's, you may receive a vehicle if your story is inspirational enough, but we must strongly emphasize that your application is more likely to be reviewed if you have a high page rank. (Note: The applicant with the highest number of votes, page rank, or most poignant story, may not be selected to receive the vehicle and the recipient may be selected from any geographic location.)

7) Q-What type of automotive related help does FREE Charity Cars provide?
A-Besides providing more FREE vehicles than anyone in the nation, our charity can provide financial assistance for tag/title/registration fees, automobile repairs, preventative maintenance items like oil changes, hoses, belts, batteries, brakes, tires, automotive warranty coverage, roadside assistance memberships, and the down-payment for auto insurance or even the down-payment for a new or used vehicle! We can assist with just about anything automotive related as long as the applicant has completed our application, qualifies, and has made the effort to help themselves and others by spreading the word about FREE Charity Cars.

8) Q-How do I apply for automotive related help?
A-Simply make the request in the "Tell the world your story" section on your profile page.

9) Q-I don't really need a car so how do I transfer my votes to a friend?
A-Simply email us from your profile page and specify the date you want us to execute the transfer and the username of the person you want to transfer your votes to.

About Free Charity Cars

Who We Are
The Original Charity Cars (DBA Free Charity Cars) is a 501-C-3 non-profit charity, EIN 59-3362703. Established in 1996, our founding mission is to provide refurbished donated vehicles to struggling individuals or qualified entities. Considered the pioneers of the free car-ownership concept, our entrepreneurial organization is totally self-sufficient and succeeds without a penny of government funding. Year after year, our charity leads the nation in awarding free vehicles to deserving candidates across America (over 4000), many times paying for the down-payment for auto insurance, as well as the tag, title and registration fees. Additional auto related assistance provided may include mechanical repairs, body-shop repairs, roadside assistance, warranty purchases, parts purchases, rental cars, or even the down-payment for the purchase of a new or used car.

The Original Charity Cars has enjoyed an avalanche of local and national publicity, including being featured on Oprah, Montel Williams, Good Morning America, CBS Morning News, and Two Guys Garage. Articles about the program have appeared in a host of publications including People Magazine, Women's World Magazine, Motor Trend, The Non-Profit Times, and The Chronicle of Philanthropy. Among its many awards, our organization is honored to be a past winner of the prestigious Walt Disney World Outstanding Community Service Award.

Our diverse portfolio of charitable projects includes:

www.FreeCharityCars.org - Free car and auto-related assistance portal.
www.800CharityCars.org - Vehicle donation portal. Also provides critical funding support to many other non-profits both locally and nationally.
www.800CharityFarms.org - Begun as a 35-acre organic farm dedicated to feeding the homeless, the program has expanded through our Charity Farm Corps, Charity Victory Gardens, and Charity Farmers Market projects. This is a sustainable and attainable planetary hunger and health solution.
www.1-877-Charity.org - Our free car-donation processing service for other charities, 100% of the direct net sales proceeds from each donated vehicle goes to the charity of the donor's choice. Contrast that with the results of current government studies which conclude that only about 35% of the revenue ever reaches the charity when a 3rd party entity is involved in the car-donation process.
www.800CharityDomes.org - Currently in development, our off-the-grid domes offer a dignified solution to the homeless housing and migrant farm worker housing challenges confronting communities across America. Our goal is to establish a sustainable, totally off-the-grid homeless shelter and organic farm. The healthy living curriculum will be centered on healthy eating and consciousness raising techniques.
